1. Airwaves Volume 5 Compilation CD Overview:

BandRadio.com is calling for unsigned and artists/bands to submit their best songs in competition for possible inclusion on the "Airwaves Volume 5" compilation CD. BandRadio.com will select 14 - 15 winners. [Details of the selection process are included in section 6.]

If selected, your music will appear on the Volume 5 compilation CD that will be distributed directly to top music industry creative executives in A&R, music publishing, film & TV music as well as artist managers, record producers, music attorneys, radio programmers and more. The CD will also be promoted and sold online and possibly in retail outlets.

As a winner, you will receive 10 free copies of the CD that are yours to distribute as you see fit. This will allow all of the artists/bands on the compilation to have a chance to be heard in regions/venues that may otherwise not have been accessible. If you wish to distribute the CD to your own contacts, local college radio stations, commercial radio stations, etc., then by all means do so; this affords all the artists even more exposure. Keep in mind that the other artists/bands will be doing the same.

2. Who Is Eligible:
a) Any recording artist/band that is not currently under contract with a record company.
b) Artists/bands signed to publishing deals but who do not have recording contracts will also be accepted.
c) All music submitted must be 100% owned and copyrighted to entrant and master rights to the sound recording must be 100% controlled by the entrant. All submissions must be entrant's original work. Any song containing any "Samples" will be automatically disqualified. No song previously recorded and released through national distribution in any country will be eligible.
d) All entrants must be eighteen (18) years of age or older at the time of submitting material.
 

3. Process to Enter and Submission Fees:

You may enter by postal mail or online.
To enter by mail:
a) Send a completed and signed submission form.
b) Send 1 Audio CD. Must be master quality. No cassette submissions will be accepted.
c) Submission Fee (US Dollars Only): $15.95 for one song and $9.95 for each additional song. All submission fees are non-refundable.
d) Fee Payment: Send check or money order payable to BandRadio.com. An additional $25 fee will be charged for returned checks. You may pay by credit card. Ocampa will process Visa, MasterCard, Discover and AMEX payments for BandRadio.com.

4. Submission Rules:
Mail your submission form, fees, and one (1) master quality audio CD to BandRadio.com. No cassette submissions will be accepted. If you submit online and your song is chosen, you must supply a master quality CD with that song to us by mail within ten (10) days of your notification by BandRadio.com in order to be included on the compilation.


An artist/band may submit as many songs as they wish. All songs submitted must be original compositions and at least two and a half (2.5) minutes and not more than five (5) minutes in length. We accept and review all genres of music.


Writers retain all rights to their songs and lyrics. Submissions must not contain samples or other copyright infringing elements that require clearance. Profanity will be edited out of songs in order to obtain a slot on the compilation.


Only one (1) artist/band per submission. BandRadio.com will review the songs that you have clearly marked for review on the submission form. If you wish to submit additional artists/bands, a separate submission form and separate fee are required. Agents and Managers may combine multiple submissions in one package and pay with a single payment as long as each artist/band completes a separate submission form. Submissions do not guarantee inclusion on the compilation CD.


Due to the volume of submissions we receive, unfortunately BandRadio.com will not be able to provide "feedback" or "reviews" of individual submissions. CD's or other materials submitted to BandRadio.com for the "Airwaves Volume 5" compilation will not be returned.

5. Submission Deadlines:
The submission deadline for BandRadio.com Airwaves Volume 5 is January 31, 2008. Entries must be postmarked on or before January 31, 2008 in order to be eligible for consideration.

6. Music Review & Selection Process:
All music submitted to BandRadio.com will be reviewed by a panel of recording industry professionals, as well as BandRadio.com staff. Final music selections are based, in part, on commercial potential, originality, overall quality of performance and production. All decisions of BandRadio.com will be final and will not be subject to appeal or review.

7. Notification:
Final artist/bands selected will be notified personally by telephone, overnight mail delivery or email. Song writer(s) and performers must sign and return an Agreement confirming that the selected song is original, that he/she controls the rights to the song and that he/she consents to its use by BandRadio.com. Signing this agreement gives BandRadio.com permission to duplicate your song for the purpose of including it on the "BandRadio.com Presents: Airwaves Volume 4" compilation CD. At that time, you will also be asked to provide information regarding your performing rights organization affiliation (i.e. BMI, ASCAP, SEASAC, etc) as well as your publishing information. Failure to sign and return the agreement within 10 business days of notification will result in immediate disqualification and an alternate artist/band will be selected. All artists/bands whose music is not selected for the compilation CD will be notified via email shortly after the final decisions have been made in May 2008.

8. Release:

By submitting an entry(ies) , entrants agree to be bound by these rules and by the decisions of BandRadio.com, which are final in all matters relating to the project. Entrants hereby release and hold BandRadio.com and its sponsors harmless from any and all liabilities, actions, suits, claims and demands of any kind which may be connected in any way with this project, or that otherwise arise in any way in connection with this project and will indemnify BandRadio.com for any and all costs and expenses incurred in defending any rights or claims made regarding entrant. All submissions constitute permission to use artist/band names, likeness and music for future publicity and advertising purposes without compensation. BandRadio.com makes no claims or guarantees of publication, recording, or other use of your material by any industry professionals.

9. Royalties:

All winners will provide BandRadio.com with a royalty-free license to use the selected song(s) on a non-exclusive basis. Winners that are selected and appear on "Airwaves Volume 5" will be paid mechanical royalties for the song that is included on the CD in the statutory amount of $.08 per copy sold. If there was more than one writer on the song, it will be the artist/band's obligation to disburse the mechanical royalties paid by BandRadio.com to the writers/publishers in the appropriate share(s). It is the artist's responsibility to register the songs with a tracking agency such as ASCAP or BMI to receive royalties for airplay.

10. Artists Rights:

You will retain all rights to your songs/music/lyrics.

11. Samples:

Each band will receive ten (10) copies of the "Airwaves Volume 5" CD at no charge. Payment of all federal, state and local taxes is the sole responsibility of the winner.

12. Miscellaneous:

BandRadio.com is not responsible for lost, damaged, misdirected, postage due, stolen or misappropriated submissions.
